IMPORTANT: Please read these terms and conditions carefully in conjunction with the general Website Terms and Conditions and Privacy Policy before using the www.bluesystems.info website (the “Website”), as well as the Blue Systems Service Terms and Conditions (together, and including the agreement and terms and conditions referred to in clauses 4 and 5 below, the “Additional Terms and Conditions”), as they all apply to your use of the Website (or any part) and use of any of the Software and Content (defined below) provided to you by Blue System (Middle East) Limited, Suite 702, Old Al Ahli Bank of Kuwait Building, Baniyas Road, Deira, PO Box 40086, Dubai, UAE (“Blue Systems”).
DISCLAIMER: The risk of loss in equities, CFD’s, fixed income, FX, futures and options trading can be substantial. You should very carefully consider whether such trading is suitable for you in the light of your financial circumstances. The high degree of leverage that is often obtainable can work against you as well as for you and can lead to large losses as well as gains.
1. Non-Professional User Status:
Individual customers are deemed to be non-professional users and must agree to the non-professional user declaration on this Website. Users must provide certain exchange compliance information before being permitted to use any of the Software and Content, and for non-professional exchange fees (if applicable) to apply. Professional customers must contact Blue Systems sales representatives.
2. Pricing for Individual Users:
Blue Systems will bill individual customers in local currency for all software, exchange fees and third party content (together “Software and Content”).
Exchange fees reflect the prices exchanges charge all individual non-professional users for viewing their real time data. Software and Content pricing is subject to change without notice.
3. Contract Term and Cancellation Terms and Changes to Subscription:
The minimum subscription term is for one month with one month’s notice required for cancellation. Users can modify their subscriptions or cancel their service by logging into “My Account”, the secure login section of the Website. Please note that e-mailing or sending an Instant Message to support@bluesystems.info does not constitute proper communication for modifications or cancellation of service.
4. Credit Card Repeat Billing:
Blue Systems will charge for Software and Content for an entire month irrespective of the date of subscription within the month. Thereafter, subscriptions will be charged on a month in advance direct debit basis on the 28th of the month unless the subscription is cancelled (see clause 3 above).
5. Mobile Phone Contracts:
Customers will have to enter into a separate contract with a Mobile Network Operator for any handset, voice, text and data package they subscribe to. Any questions relating to tariff subscriptions or the service should be directed to the Mobile Network Operator and not Blue Systems.
6. Market Data Feeds:
Market Data is provided by IDC (www.interactivedata.com). Individual customers must accept Blue Systems’ and /or IDC’s Terms and Conditions on the Website to become a user of exchange feeds. In parallel to IDC’s Terms and Conditions, Blue Systems requires that:
- Customers are prohibited from sharing/distributing data with any third parties.
- User names and passwords are personal to the user and will be withdrawn if there is any evidence of abuse.
- Cancellation or termination of Blue Systems Software and Content service automatically terminates the Interactive Data's Terms and Conditions and vice-versa.
- On cancellation of the Blue Systems Software and Content service, the user name and password will also be cancelled and the user will have no further access to any service.
7. Third Party Content:
- For Blue Mobile™: All customers will have access to business newswires.
- WVB: WVB data is bundled with Blue Mobile™ and included in the subscription.
8. Refund Policy:
Blue Systems may in its discretion offer a subscription refund if the Software and Content service is cancelled before customers have been registered with an exchange. Registration normally happens within 24 hours of services being requested by customers. If a customer has been registered with the exchange as an end-user, the full cancellation period applies, even if the customer has not used the service. All questions regarding refunds should be addressed to Blue System (Middle East) Limited, Suite 702, Old Al Ahli Bank of Kuwait Building, Baniyas Road, Deira, PO Box 40086, Dubai, UAE.
9. Copyright Notice:
All right, title and interest in and to the Software and Content (or any components of the same) are and shall remain with Blue Systems or its suppliers (as appropriate). The software, any information contained within any service and/or documentation consists of proprietary products of Blue Systems or its suppliers (as appropriate), which are protected under copyright and other intellectual property laws.
10. Customer Acknowledgement:
The Customer hereby acknowledges and accepts that he has read each of the applicable Additional Terms and Conditions, that the same form an integral part of these Individual User Terms and Conditions and that they are expressly incorporated herein.
